Trump's former lawyer leaves her post in the wake of court rules against her appointment.
Alina Habba has resigned as the chief federal prosecutor in the state. This decision was prompted by a court battle that invalidated her legal standing to serve.
Official Departure
US Attorney General, Pam Bondi, confirmed her stepping down on Monday. In a statement that the court's "flawed" ruling made it unworkable for the official to effectively run her office.
"But do not mistake following the order as giving up," Habba stated. "The effort will now reach across the nation."
Judicial Challenge
Habba's exit was triggered by a federal appellate panel ruled that she had been serving in violation of the law as the federal prosecutor. This ruling is could influence scores of legal proceedings in the Garden State.
The judicial panel said that a temporary posting that skirted Senate approval breached the statute on vacant positions.
Future Role and Reaction
Bondi said that Habba will remain at the justice department as a senior adviser. Habba plans to seek further review of the ruling, aiming for a overturned decision.
On a social media platform, the Attorney General wrote that the judiciary "must not second-guess the appointment of attorneys responsible for performing the fundamental role of the presidency of criminal prosecution."
Performance in Office
She commended Habba's record and pointed out that under her leadership, the Newark saw a one-fifth decrease in offenses. Additionally that the city of Camden experienced its first summer in 50 years without a homicide.
Connection to Donald Trump
Habba, was initially recruited to Trump's personal legal team in 2021. She went on to acted for her client in his New York criminal case in 2024, when he was conviction on 34 counts of document fraud.
Earlier, her appointment to the top New Jersey post, Trump had stated he was appointing her as his presidential counsellor if re-elected, labeling Habba as a steadfast ally and a dedicated fighter for justice.
